Eligibility: The King or Queen of Halloween Contest (the “Contest”) in connection with the 2019 Voodoo Music + Arts Experience (the “Festival”) is open only to natural persons who are legal United States of America residents, who are at least eighteen (18) years of age, who have a valid social security or tax ID number, and who have an Instagram or Twitter account at the time of entry. Contest may only be entered from and in eligible jurisdictions. Contest Entities, prize providers, landlords or licensors (related to the Festival), if any, Live Nation Entertainment, Inc., Live Nation Worldwide, Inc., New Orleans City Park Improvement Association, The Park Employment and Procurement Corp., Friends of City Park, The City of New Orleans, The Louisiana Dept. of Culture, Recreation, and Tourism, The State of Louisiana, and their respective parents, partners, divisions, subsidiaries, officers, directors, members, managers, affiliates, agents, and employees (and each of their immediate family members (i.e., parents, legal guardians, children, grandparents, grandchildren, spouses or siblings and their respective spouses) and those living in their same households, whether or not legally related) are not eligible to enter or win. In the event of a dispute as to the identity of an entrant, the authorized account holder of the account will be deemed to be the entrant (“Entrant”). Contest Entities may request any potential winner to provide proof that such person is the winner. All potential winners are subject to verification before any prize will be awarded. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Contest Entities’ decisions, which are final and binding in all matters related to the Contest. Sponsor: The Sponsor of this Contest is Voodoo Music Experience, LLC (“Sponsor”).
Administrator: The Administrator of this Contest is C3 Presents, LLC (“Administrator”).
Sponsor and Administrator are collectively referred to herein as “Contest Entities.”
Timing: Administrator’s clock is the official time keeping device of the Contest. Submission Period and Judging Period are collectively referred to herein as “Contest Period” and are described below.
Submission Period begins at 10:00 AM Central Time (“CT”) on September 6, 2019 and ends at 12:00 PM CT on September 20, 2019.
Judging Period begins at 1:00 PM CT on September 20, 2019 and ends at 11:00 PM CT on September 22, 2019, unless otherwise extended in Sponsor’s sole and absolute discretion.
Finalist Voting: The top 3 entries (as determined by Contest Entities during the Judging Period) will be posted to www.twitter.com and www.instagram.com on Monday, September 23, 2019 at 10 AM CT. Of these three entries, the entry that receives the most “likes” from fans by Friday, September 27, 2019 at 12 PM CT will be deemed the Contest winner. Winner will be notified by 11:59 PM CT on September 27, 2019.
How To Enter: Via the Internet, Entrant may submit one (1) Contest entry via Entrant’s Instagram or Twitter account. Criteria for judging is under “Judging, Selection and Verification of Winner” below. To enter:
- Log into Entrant’s Instagram or Twitter account. Create a public post (Instagram) or public tweet (Twitter) and upload Entrant’s Image (from Entrant’s Instagram or Twitter account) with the hashtags #VoodooFest and #CostumeContest (the stated required actions are collectively a “Submission”). Entrant’s Instagram or Twitter account must be set to public at time of Submission and until October 25, 2019 as entries with a private account setting may not be captured.
Contest Entities are not responsible for the functionality of the Instagram or Twitter platforms, including changes that may interfere with the Contest or the ability of a potential Entrant to participate in the Contest.
To enter, an Entrant must be a registered user of Instagram or Twitter. If Entrant is not a registered user of Instagram or Twitter, the Entrant must visit www.instagram.com or www.twitter.com to register for free. Registration for and use of the Instagram or Twitter platforms is subject to their terms and conditions and Contest Entities have no responsibility with respect to such registration or use.
For all entries: Each Entrant is eligible to submit up to one (1) Submission during the Submission Period, regardless of method or combination of methods of entry or number of entries submitted. Entrants are not permitted to share the same email address or other relevant account. Any attempt by any Entrant to submit more than one Submission by using multiple/different email addresses, identities, registrations and logins, or any other methods will void all Entrant’s entries and that Entrant shall be disqualified. Use of any automated technology or system to participate is prohibited and will result in disqualification. Any automated receipt (such as one confirming delivery of text message or e-mail) does not constitute proof of actual receipt by Administrator of a Submission. Contest Entities are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. All entries shall become the property of Contest Entities and none will be acknowledged or returned.
During the Contest Period, qualifying Submissions may be posted onto any websites or social media platforms that the Contest Entities in their discretion may determine and viewed by the public. Contest Entities shall have the right to immediately remove any and all Submissions that violate these Official Rules, in the sole direction of the Contest Entities. As conditions of entry into this Contest, and submitting a Submission, each Entrant:
- Warrants and represents that he or she has the written consent, release, and/or permission of each and every identifiable individual person in the Submission to use his/her respective name or likeness to enable inclusion and use of the Submission in the manner contemplated by Contest Entities and these Official Rules, and can make written copies of such permissions available to Contest Entities upon request;
- Acknowledges and agrees that Contest Entities may exploit, edit, modify, display and distribute the Submission and all elements of such Submission, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to Entrant or any third party;
- Warrants and represents that his or her Submission is original to the Entrant and has been legally obtained and created, does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations;
- Warrants and represents that its Submission does not contain any unlicensed images;
- Agrees to conduct itself with due regard to public conventions and morals, and shall not do or commit any act that might prejudice Contest Entities during the Submission Period; and
- In the event Entrant cannot provide all required releases, Contest Entities reserves the right, in their sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Contest Entities’ benefit or allow the applicable Submission to remain.
Entrant agrees that its Submission shall not contain, include or involve any of the following:
- Published material under copyright (not owned by Entrant) or contract
- Crude, vulgar or offensive pictures, depictions, images, language and/or symbols
- Gang signs or symbols
- Explicit sexual activity
- Illegal drug or alcohol use
- Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements
- License plates, phone numbers, personal addresses (physical or email or otherwise)
- Website or web page links
- Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise), any assault or threatening of others
- Trespass or the violation of other people’s rights or property
- Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress)
- Conduct or activities in violation of these Official Rules
- Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by Contest Entities, in their sole discretion.
Contest Entities are not obligated to use, publish, display or broadcast any submission materials of a Submission; provided however that each Entrant acknowledges that Contest Entities will rely on such Entrant’s agreement and compliance with these Official Rules when Entrant submits or attempts to submit the Submission and qualify for judging.
Prize: One (1) Grand Prize consisting of two (2) weekend VIP tickets to the Festival at City Park in New Orleans, Louisiana; (2) Hotel accommodations consisting of one room, checking in October 25 and checking out on October 28, 2019 (hotel at Contest Entities’ sole discretion); (3) Two (2) round-trip coach flights on the airline selected by Contest Entities and valid for travel by the Contest winner and Contest winner’s selected guest during the Festival weekend (selection of airline is solely within Contest Entities’ discretion and the flights must depart from a major gateway airport closest to the Prize winner’s residence in the continental U.S. to New Orleans, LA); (4) $500 to build your perfect Halloween look for the Festival (method of payment at Contest Entities’ sole discretion, including by gift card to a local costume shop); and (5) the opportunity to be featured in the Festival’s costume extravaganza. ANY ADDITIONAL TRAVEL, PARKING AND ACCOMMODATIONS NOT INCLUDED HERE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Contest Entities are not responsible for changes in schedule of any element of the Prize or for any expenses incurred as a consequence of flight cancellation or delay. Contest Entities are not responsible and will have no liability whatsoever if the Prize winner and/or his/her guest is for any reason not permitted to travel by the relevant airport authorities or misses a flight or other travel element. If a potential Prize winner is unable or unwilling to travel on the dates specified in these Official Rules, the Prize will be forfeited and may be awarded to an alternate winner at the Sponsor’s discretion. All travel is subject to availability and restrictions. The Prize winner and its guest must travel on the same itinerary and are subject to all rules and regulations of the airports and airline. The Prize winner and its travel guest must have all necessary identification and/or travel documents (e.g., a valid U.S. government issued passport or valid state issued driver’s license) required for travel. Hotel reservations will be reserved under the Prize winner’s name and the Prize winner must present a valid photo ID and a credit card for incidentals at the time of check-in. Contest Entities reserve the right to not award any prize to, or to revoke full or partial prize from, any winner or winner’s guest who Promotion Entities and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, and/or may bring Promotion Entities into disrepute. The prize is non-transferable and resale of tickets is prohibited. Approximate total retail value of the Prize is: Three Thousand Five Hundred Dollars ($3,500).
For all prizes: Odds of winning a prize depends on the number of eligible entries received. There will be only one prize. Lost or stolen prizes will not be replaced. Prize does not include any other item or expense not specifically described in these Official Rules, and any such additional expenses are the sole responsibility of winner. Prizes may not be transferred or assigned. Only listed prizes will be awarded, and no other prizing or substitutions will be made except at the sole discretion of Contest Entities. Winners agree to accept the prize “as is”, and Entrants hereby acknowledge that Contest Entities has neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Any valuation of the prizing stated above is based on available information provided to Contest Entities and the value of any prize awarded to a winner will be reported for tax purposes as required by law. Grand Prize winner is solely responsible for reporting and paying any and all applicable taxes. Grand Prize winner must provide Contest Entities with a valid taxpayer identification number or social security number before any prize will be awarded. A Form 1099 will be issued to the Grand Prize winner for value of prize $600 or more.
Judging, Selection and Verification of Winner: All Submissions will be reviewed and ineligible and/or incomplete Submissions will be disqualified. All eligible Submissions will then be judged during the Judging Period by a qualified panel of judges based on the following criteria: 33% – well-executed head to toe look, 33% creativity, 34% Most engagement (likes and comments) on entry post. The three Submissions that receive the highest overall scores will be posted by Administrator on Voodoo’s official Twitter and Instagram and the entry with the most likes by contest end date will be selected as a Grand Prize Winner (all details as provided above). If there is a tie after the judges apply the criteria, Administrator will bring in a tie breaking judge to apply the same criteria to break the tie and determine which Entry moves on to the final round.
Contest Entities shall contact potential winner via a direct message to the Instagram or Twitter account used to enter on or about September 27, 2019. Direct message will come from Administrator. Selected Entrants must respond to Administrator within forty-eight (48) hours of notification or attempted notification by Administrator. If an Entrant’s notification is undeliverable or in the event of non-compliance with any of the Contest rules, the applicable prize shall be forfeited, or in the event the selected Entrant declines the prize, the Entrant who received the next highest overall score during the Judging Period may be selected at Contest Entities’ discretion.
Contest Entities’ decisions as to the administration and operation of the Contest and the selection of Entrants are final and binding in all matters related to the Contest. Contest Entities reserves the right to disqualify any Entrant and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Contest, or obtained Entrant status using fraudulent means.
All potential winners are subject to verification by Contest Entities. Contest Entities will not accept screen shots or other evidence of winning in lieu of its validation process. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Potential prize winner will be required to sign and return a Liability Release (“Release”) and an I.R.S. Form W-9, which must be received by Contest Entities within three (3) days of the time notice or attempted notice is sent, in order to claim a prize. Notification is deemed to have occurred immediately upon sending of a direct message or of an email. If a winner is a minor in his or her state of residence, the Release must also be executed by the winner’s parents or legal guardians. If a potential winner of any prize cannot be contacted, fails to sign and return the Release within the required time period (if applicable), declines the prize or prize is returned as undeliverable, such potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, Contest Entities will award the corresponding prize to an alternate winner by random drawing from among all remaining eligible entries. All alternate potential winners are subject to all requirements set forth in these Official Rules. Only one (1) alternate winner will be selected, after which the prize will remain un-awarded. Any alternate prize winner is subject to all requirements set forth in these Official Rules.
Publicity: Except where prohibited, participation in the Contest constitutes winner’s consent to Contest Entities’ (and their affiliated entities’) use of winner’s name, social media identity, likeness, photograph, voice, opinions, hometown and state for promotional purposes in connection with this Contest in any media, worldwide, without further payment or consideration.
Errors and Unauthorized Activity: Contest Entities are not responsible: (1) for any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) for technical and/or communications malfunctions, errors or failures of any kind; (3) for unauthorized human intervention in any part of the Contest; (4) for technical or human error which may occur in the administration of the Contest or the processing of entries; (5) for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize; or (6) if the Contest cannot take place or if any prize cannot be awarded due to acts of war, natural disasters, weather or acts of terrorism. If for any reason an Entrant’s Submission is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Contest Entities, at their discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Contest Entities reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Contest Entities reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Contest Entities’ reasonable control impairs the integrity or proper functioning of the Contest, as determined by Contest Entities in its sole discretion. In such event, Contest Entities reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Contest Entities reserve the right, in their sole discretion, to disqualify any individual it suspects or finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Contest Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. Contest Entities’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release: By participating in the Contest, Entrant (a) releases Contest Entities, prize providers, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, from any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Contest, including the unauthorized or illegal access to personally identifiable or sensitive information or acceptance, possession, use, misuse, or nonuse of the prize that may be awarded; and (b) acknowledges that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, without limitation, the prize quality or availability.
Disputes: As a condition of participating in the Contest, Entrant agrees that: a) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b) all causes of action arising out of or connected with this Contest or the prizes awarded, shall be resolved individually, without resort to any form of class action, exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; and c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred and in no event shall Entrant be entitled to receive attorneys’ fees or other legal costs. Contest Entities reserves the right to modify prize award procedures. The Contest and these Official Rules, and the validity, construction, performance, and enforcement thereof, shall be governed by and construed in accordance with the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
